Affiliate Program Terms and Conditions

These Affiliate Terms and Conditions ("Agreement") govern your participation in the UrushiPen.com Affiliate Program ("Program"). By signing up or participating in the Program, you agree to be bound by these terms and conditions. If you do not agree, you may not participate in the Program.

1. Eligibility

To participate in the Program, you must:

  • Be at least 18 years old.
  • Own and operate a website, social media page, blog, email list, or other online channel with appropriate content.
  • Comply with all applicable laws and regulations.

UrushiPen.com reserves the right to approve or reject any application for any reason.

2. Affiliate Responsibilities

As an affiliate, you agree to:

  • Promote UrushiPen.com products using your unique affiliate links.
  • Not make false or misleading claims about UrushiPen.com products.
  • Clearly disclose your affiliate relationship in compliance with FTC guidelines.
  • Not engage in spam, paid traffic without approval, coupon sites (unless pre-approved), or any deceptive practices.
  • Refrain from bidding on UrushiPen.com branded terms (e.g., "UrushiPen", "UrushiPen.com") in paid search campaigns.
  • If a sole-proprietor (you don’t own a business), to set up an account in UrushiPen.com’s system to be a 1099 contractor.

3. Commissions and Payments

  • Affiliates will earn a percent commission established by UrushiPen.com of the net sale (excluding taxes, shipping, and returns) for every referred purchase made through their unique link or discount code.
  • Commissions are paid on valid sales only, after a 30-day holding period to account for returns and cancellations.
  • Payouts are made monthly via the preferred method established by both parties.

4. Prohibited Activities

The following are strictly prohibited and grounds for immediate termination and forfeiture of unpaid commissions:

  • Promoting UrushiPen.com on websites or channels that include hate speech, adult content, violence, or illegal activity.
  • Misrepresenting UrushiPen.com products, pricing, or availability.
  • Using unauthorized or misleading promotional materials.

5. Intellectual Property

Affiliates may use UrushiPen.com approved images, logos, and text for promotional purposes only. All intellectual property rights remain with UrushiPen.com. Unauthorized use or modification is prohibited.

6. Termination

Either party may terminate this agreement at any time, with or without cause. Upon termination:

  • All rights granted to you will be revoked.
  • You must remove all UrushiPen.com links and promotional materials.
  • Any unpaid commissions from valid sales made prior to termination will be paid in accordance with this agreement.

7. Limitation of Liability

UrushiPen.com shall not be liable for indirect, incidental, or consequential damages (including lost profits) arising out of or related to this Agreement or the Program.

8. Changes to the Terms

UrushiPen.com reserves the right to update or modify these terms at any time. Affiliates will be notified of significant changes. Continued participation in the Program after such changes constitutes your acceptance of the revised terms.

9. Independent Contractor Status

You are an independent contractor. Nothing in this Agreement creates a partnership, joint venture, or employment relationship between you and UrushiPen.com.

10. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Maryland, without regard to conflict of law principles.
